Meeting Called To Order: Council Members present at this meeting were Judy DeVries, Earl Gaerte, Gary Sriver, Christopher Sailors, James Widman, Dave Helt, Kathy Siders and Chief Deputy Auditor Penny Shireman. Council Minutes: Council President James Widman referenced the minutes of the Council meeting on April 15, 2008, for any additions or corrections. Jim called for a motion to approve the minutes as corrected. Judy DeVries moved to approve the minutes of April 15, 2008, meeting as corrected. Chris Sailors seconded this motion. Motion carried 7-0. Assessor: Assessor Susan Carr reported that as of July 1, the township trustees’ duties transfers to her office. She said she would like to hire Angie Whetstone full-time as first deputy for the Rochester Township and keep Karen Miller until the end of the year. She also said she has two township trustees that have Level II Certification who have never been paid for this. She reported that Art Gudas would be entitled to three years’ pay at $1,000 and Peggy Dague got her certification this year and would be entitled to $1,000. That would come from the Reassessment Fund. She reported compliance on 06/07 rural properties. She is now waiting for DLGF to approve ratio studies. She presented a memo from Barry Wood saying where they are in that process. Susan introduced Cindy Gross, Deb Monroe and Bill Hayes from Appraisal Research Corporation. Ms. Gross explained the process and Fulton County’s place in the process. She said that 21 Indiana counties were ordered to re-trend, which really slowed down the 06/07 data approved. Jim asked if there would be some idea of what the Council can base the budget for 2009. They believe they can provide an estimate. Sheriff: Sheriff Walker Conley presented his monthly reports. He reported that the Auditor requested the formula for his figures for the cost of housing on behalf of an anonymous Council member. He noted that if anyone has any questions about the information he presents, that he is willing to answer any questions. Waiver of Abatement for Non-Compliance Request: Attorney Ted Waggoner, representing Rochester Homes, Inc., said he filed a Petition For a Resolution Approving a Waiver of Non-Compliance for the Council’s consideration. He explained the confusion in the abatement granted in 1998 for which the company was not given tax credit. He suggested two ways to resolve the problem. One would be for the County to repay the $26,000 paid in taxes that shouldn’t have been paid and Rochester Homes live out the remainder of the tax abatement. The other would be to implement the abatement beginning 2007/pay 2008 tax period. Kenny Anderson, owner of Rochester Homes, reported having over the agreed upon number of employees until two years ago. RESOLUTION #051308 APPROVING WAIVER OF NON-COMPLIANCE Rochester Homes, Inc., a Fulton County taxpayer, has petitioned the Council to approve a Waiver of Non-Compliance with the tax abatement statutes, as permitted under Indiana Code 6-1.1-12.1-11.3(a)(5)(A). The Council, having given Notice of Hearing on the Petition, and heard a presentation by the Petitioner and its attorney, and the comments of the public, now finds it appropriate to grant the Petition, waive the non-compliance and set the following as the remedy for the petitioner. The Fulton County Council grants the start of the ten year abatement of Rochester Homes, Inc., effective with the 2007 pay 2008 taxes for the abatement approved by this Council on July 21, 1998, by Resolution #0721-1998. The amount approved is assessed at this time at $412,490. Earl Gaerte seconded this motion. Motion carried 7-0. Wheel Tax: Jim Widman opened the discussion on the proposed Wheel Tax for a third reading. Amy Weaver asked about Major Moves money. Superintendent Dave Tofson explained that it was only to be received for two years and that the last of that money is in this year’s budget. There was significant discussion on this topic. It was noted that the biggest complaints are from those who have multiple vehicles and the cost for a motorcycle. It was reported that 26 of the Indiana counties use CEDIT funds for road maintenance, two use CAGIT funds, Marion County uses $3.8 from parking fees, 42 to 45 Indiana counties have a Wheel Tax enacted. The Council decided to go with a percentage of the excise tax paid rather than a fixed surcharge per vehicle. The percentage is 8% with a minimum of $7.50. ORDINANCE 101607-C WHEREAS, PL 1 – Acts 1980 Section (IC 6-3.5-4) authorizes the County Council to impose, by ordinance, a local annual Excise Surtax of (not less than 2% or more than 10% (w/a $7.50 minimum); or a flat fee option of not less than $7.50 nor more than $25.00) on each motor vehicle subject to the annual excise tax registered in the county and, WHEREAS, PL 10 – Acts 1980, Section 5 (IC 6-3.5-5) authorizes the County Council to impose by ordinance, a local option annual Wheel Tax of (not less than $5.00 or not more than $40.00) on each of 6 (six) classifications of motor vehicles not subject to the excise tax, registered in the County, and WHEREAS, PL 10 – Acts 1980, Section 4 and 5 (IC 6-3.5-4&5) requires that the local option Excise Surtax and local option Wheel Tax be imposed concurrently, and WHEREAS, Fulton County and the Cities and Towns in Fulton County have experienced a severe short-fall in Local Road and Street Distributions needed to support the safe, all-weather operation of the road and street system in Fulton County. NOW THEREFORE BE IT ORDAINED BY THE COUNTY COUNCIL OF FULTON COUNTY, INDIANA, THAT: Beginning January 1, 2009, and until further amended by ordinance, all passenger cars, trucks of less than 11,000 pounds G.W., and motorcycles registered in Fulton County, that are now subject to an excise tax shall also be subject to an annual excise surtax of ____ % or $____ to be paid with the registration of said motor vehicles. Beginning January 1, 2009, and until further amended by ordinance all of the following eight classes of motor vehicles, registered in Fulton County, shall be subject to an annual Wheel Tax as set out in the following schedule, to be paid with the registration of said vehicles. Buses owned and operated by a religious or non-profit youth organization and used to haul persons to religious service or for the benefit of their members. Vehicles subject to the annual excise surtax imposed under IC 6-3.5-5-4. Beginning January 1,2009, all of the Excise Surtax and Wheel Tax collected on motor vehicles registered in Fulton County shall be distributed, as provided in PL 10-Acts 1980, to the County, City and Town Units of Fulton County by the County Auditor and shall be used only to construct, reconstruct, repair or maintain streets, roads and bridges under their jurisdiction. Local Option Income Tax Ordinances: Jim Widman discussed these ordinances, which will shift the monies lost due to the circuit breaker on the property taxes to local income tax(es). He will be attending a meeting in Logansport on May 14, 2008, on this subject. Salary Ordinance Amendment: Dave Tofson explained that he has two road supervisors, rather than one assistant. Each of the road supervisors manages either the northern or the southern portions of the County. He said they would be paying the two road supervisors rather than three employees. AMENDMENT TO SALARY ORDINANCE RE: ADJUSTMENT to Highway Departments Approved Budget ORDINANCE #051308 The Fulton County Council hereby amends the Fulton County Salary Ordinance to provide for a change in salaries and positions as follows: There will be two (2) Road Supervisors instead of an Assistant Supervisor; Account number #702-11022-000-530 will be changed to reflect the title of Road Supervisors effective 4/21/08; The positions will have an hourly rate instead of a salary amount; The work loads will be assigned to reflect the wage changes; The budgeted amounts above are amended from the original Salary Ordinance #090607A & B dated September 6, 2007. This subject was tabled. 2009 Budget Schedule: The Council reviewed the proposed schedule and memos to the department heads regarding the preparation of the 2009 budget. Judy DeVries moved to approve the forms to be sent to the department heads for budget hearings. Earl Gaerte seconded the motion. Motion carried 7-0. Old Business: New Business: Jim presented a check from the Community Foundation in the amount of $2,677 for the semi-annual payment that has been earmarked, in part, to support the Park Board. Jeannie Cloud said the Drainage Board passed a resolution that would allow the County to borrow up to $800,000 from the GDI Fund, if needed, for expenses. Chris Sailors reported that EMS lost approximately $40,000 last month but also learned that the hospital will receive $2 million from the State. This concluded the business transacted.
