Meeting Called To Order: Council Members present at this meeting were Earl Gaerte, Christopher Sailors, Judy DeVries, James Widman, Gary Sriver, Dave Helt, Mike Gearhart and Auditor Denise J. Chandler. Council Minutes: Council President James Widman referenced the minutes of the Council and Commissioners joint meeting on February 21, 2006, for additions or corrections. Judy DeVries moved to approve the minutes as corrected. Gary Sriver seconded the motion. Motion carried 7-0. Widman referenced the minutes of the Council meeting on February 21, 2006, for additions or corrections. Judy DeVries moved to approve the minutes as corrected. Earl Gaerte seconded the motion. Motion carried 7-0. Rochester/Fulton County Finances: Widman began this discussion by noting that revenues from the tipping fees have been decreasing. He said the Council sent out in January, letters to those this may affect, that the Council was concerned that there would not be enough revenues to service the debt on the bonds or to even fund the Solid Waste District. Mayor Thompson discussed the history of the plan for the revenues of the tipping fees. He also said that he couldn’t support the Solid Waste District’s providing funds to the County highway department. Kathy Siders remembered that the revenues from the tipping fees were first to be used to service the debt on the bonds for the Courthouse renovation and that it was the Council’s discretion as to the distribution of any of these funds. Gary Sriver noted that funds are available for the current bond payment, as they store away enough for 18 months ahead. He agreed that the funding from the Solid Waste District for the County Highway Department should cease and other funding sources be explored. There was lengthy discussion regarding the possible limited access to the highway, highway funding, and host fee revenues. Some of the other participants were Ted Denton, Roger Rose, Tom Schwenk and Linda Erp. Mount Zion Update: Roger Rose updated the Council on the progress with the Mount Zion dam and bridge and their continued rapid deterioration. The Board of Commissioners has exhausted all avenues of funding short of Federal funding. One requirement for Federal funding is public ownership of the dam. A title search and survey have been completed. The current owners are willing to transfer ownership to the County at no charge. He said that a program through the Corps of Engineers provides a 65/35 grant match. Funding for the bridge is secure at a 80/20 match. Sheriff Department: Sheriff Walker Conley presented Ordinance #022007 whereby work release inmates and those inmates serving weekends would pay a fee for those privileges. The Board of Commissioners passed Ordinance #022007 on March 19, 2007. Jim Widman read Ordinance #022007 for its first Council reading. ORDINANCE #022007 AN ORDINANCE ESTABLISHING FEES FOR WEEKEND RELEASE AND WORK RELEASE WHEREAS, inmates at the Fulton County Jail are permitted to serve their jail sentences on weekends pursuant to the Courts’ sentencing orders; and WHEREAS, I.C. 11-12-5-2 authorizes the Fulton County Sheriff to establish a program whereby persons who have been committed to the Fulton County Jail on a conviction of a crime or adjudication of contempt to be temporarily released from custody to work; and WHEREAS, the temporary release from custody for work or weekend incarceration imposes a burden upon the jail staff and incurs additional time and expense to the Fulton County Jail; and WHEREAS, the Fulton County Board of Commissioners and Fulton County Council desire to establish fees for weekend incarceration and temporary release for work. NOW, THEREFORE, IT IS HEREBY ORDAINED by the Fulton County Board of Commissioners and the Fulton County Council to establish the following fees for weekend incarceration and for temporary release for work: Section 1. That an inmate shall be charged twenty dollars ($20.00) for each day that an inmate is temporarily released from custody pursuant to a work release program established by the Fulton County Sheriff. a. Participants in the work release program, residing in the work release facility, shall pay a minimum weekly fee of $100.00 b. For an inmate who lives and works outside of Fulton County, a non-refundable user fee of $200.00 will be assessed for those participants serving a period of less than 180 days and a one-time fee of $400.00 will be assessed for those serving a term greater than 180 days. Section 2. That an inmate shall be charged twenty dollars ($20.00) per day for each day served for weekend incarceration. For purposes of this section, per day shall be defined to mean each 24- hour period irrespective whether an inmate is incarcerated for the full 24-hour period. Section 3. That said fees shall be paid by the inmate prior to beginning weekend incarceration and/or paid prior to acceptance into the work release program. Section 4. The Commissioners recognize that flexibility is required and that deviation from the fees may be appropriate in the interest of fairness and justice. Therefore, either the Sheriff or the Director of Work Release shall be authorized to deviate from the fees if either believe it to be appropriate. Any and all deviations should be recorded and included in the annual report to the Commissioners. Section 5. That this repeals any existing Ordinance that might be in effect. Section 6. That in the event any section, clause or portion of this Ordinance shall be declared invalid by any Court, the remaining portions or sections shall remain in full force and effect. Section 7. That this Ordinance shall be in full force and effect upon the passage and publication as provided by law. Conley also presented his Reports of Collections for January and February, 2007. Leiters Ford Tower Site: Communications Director Steve Reese discussed the system that allows the police, fire and EMS to communicate on the east and west side of the county with the dispatch. He said the current Leiters Ford tower site is where the old fire station was located. There is a temporary trailer there now housing the equipment, which isn’t temperature controlled and not a good situation for the equipment. The Communications Board would like to see the tower site be the new fire station, which is also the preference of the fire department. Reese has received two quotes for a new tower. The quotes are for $9,494 and $9,700 for a 10 x 10 x 6 foundation with a self-supporting 100-foot steel pirod tower. Reese anticipates transferring funds for this expenditure. He said there are funds in the 911 fund for the project for a later appropriate to replace the transferred funds. Chris Sailors moved to give consensus vote for the transfer for this expenditure. Ted Waggoner: Attorney Waggoner reported that Manufactured Structures is preparing to make an addition at a cost of $420,000, an additional $100,000 or more on equipment, and increasing its number of employees from its current 37 to 62 employees. He said they would be requesting a tax abatement in the near future. Tax Abatements: Earl Gaerte and Gary Sriver will review previous tax abatements for compliance with the agreements for which the abatements were granted. CEDIT Business Plan Contest: FEDCO has determined the three winners for the Business Plan Contest and will present that during the next Council meeting. Old Business: Denise provided each of the Council members a memo that was distributed to all departments regarding cell phones. It asks for a list of County cell phones in each department, provides a copy of the policy, and asks the department heads to certify each month that there are no personal calls on the billing statements.
