Meeting Called To Order: Richard Powell called this Meeting to Order at 9:04 a.m., E.D.T. Present for this meeting were Commissioners Richard Powell; Roger D. Rose; Mark J. Rodriguez; Attorney Gregory L. Heller; and Auditor Denise Chandler. Highway Department: Highway Superintendent Dave Tofson reported road damage due to flooding on County Road 600 North east of 325 West, on 400 North west of Hwy 17, 650 North around 250 West, and Olson Road between Old 31 and US 31. He said the grinding crews are done with the grinding of expansion joints and bumps on Old 31 South and are working on Old 31 North. He said that he has sent out bills for road damage due to negligence and has received some payments. Sheriff Department: Sheriff Walker Conley presented his monthly reports. He reported that the animal warden is now certified for euthanization. He also said a freezer was donated for the carcasses of the euthanized animals. Conley said that one of the jailers is back from Iraq. He said the fill in person for that position, Brandon Parker, will be hired full-time to replace another jailer who left. He asked if the 8% probationary deduction could be waived, since he has been working for the last four months. Mark Rodriguez moved to waive the remaining probationary period and allow he be paid regular pay. Roger Rose seconded the motion. Motion carried 3-0. The Board will discuss a Road Frost/Damage Ordinance at its next meeting on June 16, 2008. Commissioner Meeting Minutes: The minutes of the May 5, 2008, and May 19, 2008, regular Commissioner meetings were reviewed. Appropriation Requests: Commissioners: 101-3980-000-068 Consulting Fee/Job Functions $25,000.00 The additional appropriation request was reviewed and approved. Claims and Payroll: The Commissioners reviewed Payroll and all Claims and signed them for payment. Akron Interlocal Agreement: Plan Director Casi Cramer asked the Board to approve an interlocal agreement with Akron whereby her office can enforce the building codes for safety. Akron would be responsible for fees incurred for this service. Akron would have to refer an unsafe building to the Board by resolution for the building inspector to inspect and ask the owner to repair. Greg Heller explained that the County currently has this same agreement in place with Kewanna and Fulton. INTERLOCAL AGREEMENT FOR THE ADMINISTRATION OF THE FULTON COUNTY UNSAFE BUILDING ORDINANCE FOR THE BEHALF OF POLITICAL SUBDIVISION WITH FULTON COUNTY THIS AGREEMENT is made and entered into by and between the Fulton County Commissioners (hereinafter referred to as “Fulton County”) and the Akron Town Council (hereinafter referred to as “Akron”). WITNESSETH; WHEREAS, IC 36-1-7 permits a power that may be exercised by an Indiana political subdivision and by one (1) or more governmental entities to exercised by one (1) entity on behalf of another; WHEREAS, both Fulton County and the Town of Akron have enacted ordinances titled “An Ordinance Adopting IC 36-7-9. Entitled “Enforcement of Building “Standards”; and WHEREAS, Akron desires that Fulton County administer its Unsafe Building Ordinance for the behalf of Akron; and WHEREAS, Fulton County is willing to administer its Unsafe Building Ordinance for the behalf of Akron; and NOW, THEREFORE, IT IS AGREED AS FOLLOWS: This agreement shall remain in effect until written termination is provided by either party to the other. The purpose of this agreement is to allow Akron to refer cases of unsafe buildings, as defined in the Unsafe Building Ordinance, within the town limits of Akron to the Fulton County Enforcement Authority, as identified in the Unsafe Building Ordinance (i.e., the Fulton County Building Inspector), for the administration of the Unsafe Building Ordinance. Akron shall by resolution refer cases that it desires to be administered by the Unsafe Building Ordinance to the Fulton County Building Inspector. The Fulton County Building Inspector shall administer cases referred by Akron pursuant to the requirements of the Unsafe Building Ordinance. Akron shall be responsible for all costs associated with the enforcement of any action required to be taken for cases to Fulton County Building Inspector. These costs include, but are not limited to, the cost of work performed by Fulton County employees or by contractors to remove or remedy the condition necessitating the referral, and legal fees associated with any court proceedings to enforce an Order issued by the Fulton County Building Inspector. In the event that Akron does not want to incur the costs associated with the enforcement of any action required to be taken for cases referred to the Fulton County Inspector, Akron may terminate the individual action without terminating this Agreement by providing written notice to Fulton County. Financing, staffing, and establishment and maintaining the budget of the Fulton County Building Inspector shall be the responsibility of Fulton County. The parties delegate to the Akron Clerk/Treasurer to receive, disburse, and account for all monies of the Agreement. Akron and Fulton County agree to hold the other harmless from any and all liability for their acts or omissions under this Agreement. He said that Judge Morton ruled that his garage was in the roadway. He said others have had this vacated because they have their houses and garages in the roadway. Greg Heller advised the Board to let the Court sort this out before taking any action. He told Mr. Turnpaugh that after it is fully litigated, he could file a Petition To Vacate a Public Way. New Business: The Board reviewed the monthly Weights and Measures report. Denise presented a memo from the Department of Local Government Finance regarding the 2008 Pay 2009 Tax and Billing Timeline. Denise reported that she had to certify Caston School district values by noon June 3, 2008. She has already had to certify for Pulaski County and Marshall County taxing districts. She will need to certify for Kosciusko County in the near future. This will leave only four townships not locked in. If the County collects more money, it will go into Excess Levy for use for the next year. If the County doesn’t collect enough money, it will cause a shortfall of cash. The Board will discuss an appointment to the Solid Waste Board at its next meeting. The Board signed the semi-annual report for the Grass Creek Planning Grant. Old Business: Denise reported that she could not locate any high grass or weed ordinances in effect for the County. Greg Heller explained how he has seen these types of ordinances work. The property owner gets a warning, and if he doesn’t comply it is done for him and he is charged for it. Mark reported having two meetings with the sheriff regarding the jail office building, also spoke with DLZ and met with Jasper Dulin and Bill Morris. DLZ will be working up a document regarding if this proposed plan should move ahead for submission to the State. There was some discussion regarding the proposed project and its potential cost. Greg Heller reported there is no State statute regarding a road damage ordinance. He said civil remedy may be the course to go if unable to get reimbursed. He left it to the Board as to enacting an ordinance or relying on civil remedy for reimbursement. He thought an ordinance would provide a procedure. This topic was tabled for the next meeting. The Board discussed the place to have the stray animals euthanized. The County Highway property seems to be the best place for this job. The Board considered getting a trailer from Jobsite. Pete Terpstra noted that there are people who are violently opposed to this. He said that he would volunteer to supervise and help build an animal shelter. There was significant discussion on this topic. The Board discussed the possibility of joining with Pulaski County to save money in health insurance. If there is a specific request to investigate insurance costs, the previously formed committee should be involved. The Board also discussed EMS costs.
