Meeting Called To Order: Richard A. Powell called this Meeting to Order at 6:05 p.m., E.S.T. Present for this meeting were Commissioners Richard A. Powell, Roger D. Rose, Leslie R. Walters, Denise Bonnell, Fulton County Auditor; and County Attorney, Gregory L. Heller. Fulton County Highway Department: Superintendent Scott Tilden presented his annual operational report for the year ended December 31, 2004. After some discussion Roger Rose moved to approve the report as presented. Leslie Walters seconded the motion. Motion passed 3-0. Scott and the Board also discussed investigating putting stop signs at railroad crossings. Scott and Sheriff Calvert will look at the necessity of stop signs at railroad crossings. George Meyer asked the Board to implement a speed limit on County Road 450 North west of U.S. 31. Scott Tilden and Sheriff Calvert will also investigate this road for the need for a speed limit. Sheriff Department: Fulton County Sheriff Roy Calvert told the Board that he is losing two of his deputies. He introduced two new deputies. These deputies have been a jailer and a member of the reserves. They will attend the academy within a year of hire. Sheriff Calvert also presented his monthly report. Round Barn Festival: Mary Ellen Lowe asked permission to use the Courthouse lawn during the Round Barn Festival on June 9, 10 and 11, 2005. Leslie Walters moved to approve this request. Roger Rose seconded the motion. Motion passed 3-0. Resolution: RESOLUTION #051605 A Resolution of the Fulton County Commissioners WHEREAS, in accordance with the provisions of Indiana Code 5-3-1-2 bids for the purchase of the equipment listed on Exhibit A were approved; WHEREAS, the assignment of such bids to Lake City Bank in accordance with the provision of Indiana Code 5-1.5 is in the best interest of Fulton County Highway Department; and WHEREAS, the borrowing entitys name shall be listed as FULTON COUNTY HIGHWAY, and, WHEREAS, the equipment will be titled to FULTON COUNTY HIGHWAY DEPARTMENT, and WHEREAS, the Fulton County Commissioners will examine the proposed Promissory Note between the Fulton County Commissioners and Lake City Bank; BE IT RESOLVED, that the equipment listed in Exhibit A will hereby be assigned to Lake City Bank for the equipment specified in Exhibit A, and provides for a fair and reasonable use of such equipment by the Fulton County Highway Department, and the execution of said Loan is necessary and wise. BE IT RESOLVED, that the execution by the Fulton County Commissioner President, Richard A. Powell, and delivery to Lake City Bank of the Loan and any and all loan supplements thereto with respect to the purchasing of the equipment authorized by this Board, are hereby authorized and approved, together with such changes in such Loan or loan supplements as may be approved as necessary or appropriate by the Fulton County Commissioners in order to carry out the transaction authorized hereby, with the execution of the Loan or loan supplements to constitute conclusive evidence of any such approval. BE IT FURTHER RESOLVED, that the Fulton County Commissioner President, Richard A. Powell, is authorized and directed to initial and date a copy of the Loan together with the loan supplement and said Loan, together with any loan supplement thereto is made a part of this resolution as fully as if the same were set forth herein. BE IT FURTHER RESOLVED, that the Fulton County Commissioner President, Richard A. Powell, is hereby authorized and directed to execute the aforesaid Loan together with any loan supplement thereto on behalf of the Fulton County Commissioners together with any other documents required thereunder, including but not limited to Certificates of Acceptance, affidavits on behalf of the Fulton County Commissioners, Uniform Commercial Code financing statements and Internal Revenue Service Forms 8038GC or 8038G. Commissioners Minutes: The minutes of the May 2, 2005, Board of Commissioner regular meeting; the May 2, 2005, executive session; and the May 2, 2005, special meeting were reviewed. Leslie Walters moved to approve the minutes of the May 2, 2005, Board of Commissioner regular meeting; the May 2, 2005, executive session; and the May 2, 2005, special meeting as presented. Roger Rose seconded this motion. Motion carried 3-0. Claims and Payroll: The Commissioners reviewed Payroll and all Claims and signed them for payment. Denise Bonnell: Fulton County Auditor, Denise Bonnell, asked the Board to support the Amendment to Ordinance 081902, allowing her office to collect a $5.00 fee for each parcel in a deed rather than the $5.00 fee for each deed. The Board gave their support for this change. Health Insurance Administrator: The Board approved changing the third party claims administrator to Cornerstone Benefits Administrator instead of Health Care Resources. Roger Rose moved to hire Cornerstone Benefits Administrator Inc. to be the Countys third party claims management provider of services replacing Health Care Resources. Leslie Walters seconded the motion. Motion passed 3-0. Old Business: Roger Rose asked Attorney Gregory Heller to review the statutes regarding the use hazardous substance funds to initially pay for the Phase I Environmental Study of the old landfill. Greg will review the statute to determine. Leslie Walters is trying to reach Jeff Nemeth regarding the energy savings plan through Nipsco. Leslie Walters reported as to the results of the termite inspection. Leslie Walters and Roger Rose went to Kings Lake with County Surveyor Don Towne to inspect the public easement under scrutiny. After review, Roger asked the Fulton County Park Board to review such requests to vacate easements. New Business: The monthly report of the Veterans Affairs Office was reviewed. Richard Powell reported there are several broken tiles on the roof that need to be replaced. The Board discussed the need for paint retouching in the Fulton Circuit Courtroom. This concluded the business of this meeting of the Fulton County Board of Commissioners. Leslie Walters moved to recess this meeting at 7:50 p.m. Roger Rose seconded this motion. Motion carried 3-0.
