Meeting Called To Order: Richard A. Powell called this Meeting to Order at 6:05 p.m., E.S.T. Present for this meeting were Commissioners Richard A. Powell, Roger D. Rose, Penny Bramble, First Deputy to the Auditor; and County Attorney, Gregory L. Heller. Fulton Circuit Court Judge Morton: Judge Morton told the Commissioners that the Circuit Courtroom was likely 85 degrees today and was told the Superior Courtroom was measurably worse. Both courts have jurors coming for multiple-day trials. He feels this is an extreme problem that could affect outcomes of the upcoming trials. Richard Powell told the Judge that there could be no air conditioning until next week due to the HVAC system. Judge Morton told the Commissioners that he has windows open through the night with fans bringing cool air through the building. Fulton County Highway Department: Superintendent Scott Tilden reported the progress on the Leiters Ford Bridge to date. He also presented a Change Order No. 1 providing a reduction in the cost of $365.46. After discussion Roger Rose moved to approve the Change Order No. 1 on Bridge #2 as presented. Richard Powell seconded the motion. Motion passed 2-0. Tilden presented Permits #4-12-05, #4-13-05, #4-14-05, #4-15-05, and #4-16-05 from Rochester Telephone Co. Scott recommended the permits for the Board’s approval. Roger Rose moved to approve Permits 4-12-05, #4-13-05, #4-14-05, #4-15-05, and #4-16-05 as recommended by Scott. Richard Powell seconded this motion. Motion passed 2-0. Tilden presented Permit #4-4-05 from Verizon. Scott recommended the permit for the Board’s approval. Roger moved to approve Permit #4-4-05 for the Board’s approval. Roger Rose moved to approve Permit #4-4-05. Richard Powell seconded the motion. Motion passed 2-0. According to the 1968 Federal Bridge Act, the culvert structures in Newcastle Township on 500 North east of 600 East and on 600 East north of 500 North for the Peter Dusenberger ditch need to be inspected. These can be added to the phase 2 bridge inspection. He thought the cost with Federal matching would be approximately $200.00 for each. Tilden also noted that he would like to replace the one on 500 North this summer. The Board examined photos provided by Tilden. Roger Rose moved for American Consulting to inspect both structures as a supplement to the 2004 bridge inspection and to have WTH do a small bridge design to replace the culvert on 500 North. Tilden has three pieces of equipment deemed surplus: a 1991 Chevrolet pick up truck, a 1990 1-ton dump truck, and 1992 Hudson trailer. The trucks were just replaced with the recent bid letting. Last fall a new trailer for the backhoe was purchased, leaving the 1992 trailer surplus. The Board asked Tilden to determine current values. The Board will then decide how to dispose of the items. Sheriff Department: Fulton County Sheriff Roy Calvert discussed two appropriation requests, one for extradition at $10,000.00 and one for jail supply at $5,000.00. He said that he needed additional money for jail supply due to the continued high jail population. He asked if extradition costs could be recouped by the defendants as part of their bonds. Attorney Heller suggested that figures be provided to the prosecutor to see if the costs of extradition could be made a part of a defendant’s restitution. Sheriff Calvert also presented his monthly report. Calvert and Jail Matron, Jennifer Berlasty, discussed previously requested changes to the personnel manual for the sheriff and communications departments. Richard Powell said that the requested changes were reasonable and would be made accordingly. Jailer Jeff Berlasty requested an ordinance mandating that weekend inmates pay a daily fee. He said that Indiana code would allow to charge up to $28.00 per day. Discussion ensued regarding who could be charged and the collection of said charges. Jeff Berlasty also asked about increasing the charge of the inmates’ co-pay for a doctor visit from $10.00 to $15.00 and for a medication from $5.00 to $10.00. These fees can be collected out of the inmates’ commissary funds. Both topics were tabled for further research. Jennifer Berlasty also noted the need for new software and the lack of funds for same. She said that the current software is 15 years old. She will also talk to the County Council and further research software. Area Plan Commission: Plan Director Casi Cramer discussed what progress is being made toward the formation of an area plan commission. She asked the Board its thoughts on a proposed 13-member board. She explained the makeup of the board. Each entity involved in the area plan commission will give their opinions on the makeup of the board and it will be finalized in an ordinance. Discussion ensued. Recess at 8:30 p.m. Reconvene at 8:40 p.m. Burning issues: Rochester Fire Chief Mike Gearhart discussed the problems with open burning. He described a situation where leaf burning was left unattended and a family’s home burned and pets were killed. The Board discussed burning education, possibly implementing burn permits, state law regarding burning, etc. Gearhart had previously asked for implementation of a burn ban, which was tabled due to the need for some use of fire. The topic was again tabled for further study. Ernie Hiatt: Fulton County Park and Recreation Board President Ernie Hiatt asked that if there was an increase in the Innkeepers Tax, that that Park Board received some of that revenue. Hiatt will also go to the Council meeting April 19, 2005. The Board believes that it is the decision of the Council. Commissioners’ Minutes: The minutes of the April 4, 2005, Board of Commissioner meeting were reviewed. Roger Rose moved to approve the minutes of the April 4, 2005, Board of Commissioner meeting as amended. Rich Powell seconded this motion. Motion carried 2-0. Resolution: RESOLUTION TO MAINTAIN STATIONARY TAX LEVY RESOLUTION #041805 WHEREAS, the Fulton County Board of Commissioners did in fact pass Ordinance #050195 to re-establish the Cumulative Bridge Fund at a tax rate of four cents (.04) each one hundred dollars ($100) of assessed valuation of all taxable personal and real property within Fulton County on May 1, 1995, as allowed under Indiana Code 8-16-3-3. WHEREAS, this resolution will put on a (1) year freeze on the Cum Bridge Levy allowing it to maintain the $255,000 Tax Levy rather than the three (.03) cent rate. BE IT FURTHER RESOLVED, this resolution becomes effective upon passage of the Fulton County Commissioners and the Fulton County Council. Fulton Town Inter-local Agreement: The Interlocal Agreement was received from the Town of Fulton. Roger Rose moved to enter into the Interlocal Agreement with the Town of Fulton as described within the agreement and that the agreement be recorded. Richard Powell seconded the motion. The Board reviewed the report of the inspection of the Indiana Fire Marshall. The Board will coordinate an executive meeting with Hufgnagel, the architect, Spike Shepler, Gregory Heller and the Board to discuss the heating and cooling systems in the Courthouse and Office Building. ATV Legalization: The Board decided against the legalization of ATV use on county roads due to safety and liability concerns. New Business: The monthly report of the Veteran’s Affairs Office was reviewed. The Board discussed a letter from Judge Morton regarding the peeling paint in the Circuit Courtroom.
