Meeting Called To Order: Richard A. Powell called this Meeting to Order at 9:07 a.m., E.S.T. Present for this meeting were Commissioners Richard A. Powell, Roger D. Rose and Leslie R. Walters; Denise Bonnell, Fulton County Auditor; and County Attorney, Gregory L. Heller. Fulton County Highway Department: Superintendent Scott Tilden told the Commissioners that he is not happy with the work done on the Sterling single axle truck by Hill Truck Sales of South Bend, who put the dump body on the truck. Tilden provided to the Commissioners the letter he sent in regard to the problem, as well as the letter of response he received back that was sent by Hill to the dump body dealer, Deeds Equipment Company. Tilden said the dump body box was set back about eight inches too far from the cab, making the front end too light when there is a load in the truck. Tilden reminded the Commissioners of the bid letting on March 18, 2005, beginning at 9:30 a.m. for equipment with three items and at 10:00 a.m. for the asphalt with five different parts of the bids. He thought it should be completed by 11:00 a.m. Tilden noted that Mike Clark went out with a representative from American Consulting for a site inspection of the Mount Zion Bridge and dam. It looks like the preliminary plan is to shift the bridge to the west, and the dam and spillway will be on the east edge of the new bridge. There was discussion regarding seeking funds from the Solid Waste District for the Highway Department, as it will no longer receive any tipping fee. Another option is to institute a wheel tax. Commissioners asked Tilden to show the decline of funds and increase of costs the Highway Department has experienced over a span of years. An INDOT representative wants to accompany Tilden and Commissioners on three site visits. At 1:00 p.m. on March 28, 2005, the Commissioners and Tilden will meet at the County Office Building for these site visits. E911: Steve Reese requested a transfer and described the loss of funds 911 is experiencing due to cell phone and Internet use over landline phones. Building Inspection Hearing Richard Powell called the hearing to order at 9:40 a.m. E.S.T. Gary Madlem, Fulton County Building Inspector, presented the status of the cases. The contact for the Cecil Raymond Patsel property is willing to have the property set on fire and then cleaned up or to hire a contractor. Gary Madlem will contact the Leiters Ford Fire Department to see if they can burn it or what needs to be done before burning it. The owner would still like to see the property go to The Oddfellows or another such organization. Roger Rose moved to continue the hearing on the Patsel property to April 4, 2005, at 9:30 a.m. Leslie Walters seconded the motion. Motion passed 3-0. The contact for the Don and Doris Nixon property is being cooperative and working to find someone to remove the trailers from the property. Leslie Walters moved to continue the hearing on the Nixon property to April 4, 2005 at 9:30 a.m. Roger Rose seconded the motion. Motion passed 3-0. Mark Grandstaff has not responded to any of the letters. The property has been sold through tax sale. Gary Madlem will contact the purchasers to determine their intentions regarding the property, i.e., whether they intend to remove the trailer or even take possession of the property. Leslie Walters moved to continue the hearing on the Grandstaff property to April 4, 2005, at 9:30 a.m. Roger Rose seconded the motion. Motion passed 3-0. Charles Harris has not responded to his fine letter. Someone approached Roger Rose regarding this property. Roger gave them Gary Madlems card so they could contact him. Roger Rose moved to continue the hearing on the Harris property to April 4, 2005, at 9:30 p.m. Leslie Walters seconded the motion. Motion passed 3-0. Attorney Heller recommended that in the future a demolition budget be added to the Countys budget for taking care of these types of situations. Auditor Bonnell suggested approaching the Council for host fee money. Gary Madlem is to send letters to each of the four regarding the continued hearings to April 4, 2005, at 9:30 a.m. Gary Madlem received notice of structures on four Kewanna properties that need to be torn down. Gary asked if he was to prepare the letters and take them to the Town Board or if he was to mail them. Attorney Heller advised that he could mail the letters, but when it came time to incur cost to repair or demolish the structures on the properties, that would be the expense of the Town. Initial hearings for these Kewanna properties will be on May 2, 2005, at 9:30 a.m. Karen Miller: Fulton County Clerk Karen Miller discussed with the Commissioners the need for EREs, special voting booths for the visually impaired that allows them to vote without assistance at each polling place. The cost would range from $3,000.00 to $6,000.00. It is federal legislation that these are provided for use. She plans to purchase a basic model. Karen has to provide a committee to oversee that all mandates are being followed in the election process. She has spoken to Marty Walters, John Brock, Charles Riddle, and the person who replaces Bob Bridge, who are willing to serve on this committee, along with the members of the Election Board. Karen would also serve on the board. The terms for these appointments are not defined. Roger Rose moved to nominate the aforementioned people to the committee. Leslie Walters seconded the motion. Motion passed 3-0. Easements: The Kings Lake and Nyona Lake (Zahn) easements will be discussed at the April 4, 2005, Commissioners meeting. Judy Reed: Fulton County Recorder Judy Reed presented material regarding House Bill 1005 that will require compliance in 2007 (pay year 2008). Counties will have to provide the people with information explaining how the taxes are calculated. Government Utilities Technology Service, GUTS representative Brent Willem told the Commissioners they can put the Countys tax information on the web for anyone to access the information from the Fulton County website. Cost is not to exceed $16,000.00. Maintenance after the first year would be approximately $2,800.00. Commissioners will take this under consideration. Joy Holloway: Mental Health Association representative Joy Holloway asked to put a banner on the Courthouse lawn advertising the groups annual antique show at the fairgrounds from Thursday afternoon through Saturday night. Commissioners granted permission. Joy Holloway also said that April is Month of the Child. She asked if an opening ceremony could be conducted at the flagpole on the Courthouse lawn on April 2 and a candlelight vigil on April 24. This is conducted by the Step Ahead Council. Commissioners also granted permission for this request. Fred Zellers: Mr. Zellers described drainage problems around Sixth Street. Commissioners will talk to Highway Superintendent Scott Tilden this afternoon to see what needs to be done to remedy Mr. Zellerss problem. Roger Rose moved to recess for lunch at 12:20 p.m. Leslie Walters seconded. Motion passed 3-0. Commissioners reconvened at 3:30 p.m. after a joint meeting with the Fulton County Council. Burn Ban: Mike Gearhart requested a countywide burn ban from the second week of March through the first week of May. Attorney Greg Heller believes that it reads that the Commissioners are authorized to institute a burn ban in the entire county or for a specific area, but it could only be for the unincorporated areas. Discussion ensued. Commissioners will discuss this further with Mike Gearhart, Rochester Fire Chief. Easement issues: Scott Tilden will be asked to review the easement issues. PETABOA Appointment: Bob Leavell was appointed to Property Tax Adjustment Board Of Appeals, PETABOA, but is unable to continue to serve. He recommended Harry Richter for the position. Roger Rose moved to appoint Harry Richter to PETABOA. Leslie Walters seconded the motion. Motion passed 3-0. Commissioners Minutes: The minutes of February 22, 2005, minutes were reviewed. Leslie Walters moved to approve the February 22, 2005, minutes as presented. Roger Rose seconded this motion. Motion carried 3-0. Old Business: Roger talked to Plan Director Casi Cramer, who will address the Plan Commission regarding exploring a US 31 thoroughfare plan by consensus of the Commissioners. There was discussion regarding the proposed legalization of ATV use on county roads. This discussion was tabled for the March 21, 2005, Commissioners Meeting to include Sheriff Calvert and to allow Attorney Heller to research the subject. Animal Warden Gene Baker has resigned. Commissioners are to hire a new one, while the sheriff is to be the day-to-day supervisor of the animal warden. New Business: Monthly reports of the Weights and Measures and Veterans Services were reviewed. This concluded the business of this meeting of the Fulton County Board of Commissioners.
